1. Acceptance of Terms
By signing up for or using the WaMeTo platform, you agree to be bound by these Terms and Conditions. These terms constitute a legally binding agreement between you and WaMeTo.
2. Description of Service
We provide a SaaS platform for WhatsApp Business API automation, which includes:
- AI Chatbot Builder and Flow Automation.
- Broadcast Messaging using Meta templates.
- Multi-agent shared inbox.
- CRM and API integrations.
- Analytics and reporting dashboard.
3. User Responsibilities & Anti-Spam Policy
As a user of our platform, you agree to strictly adhere to our Zero Tolerance Spam Policy:
- Opt-in Requirement: You must have explicit, provable consent from recipients before sending any marketing broadcasts.
- Abuse Prevention: You shall not use the platform to distribute malware, phishing links, or copyrighted material without permission.
- Automated Behavior: AI Chatbots must be configured to provide a clear "Human Handover" path to avoid customer frustration.
- Fair Use of AI: Resource-intensive AI queries are monitored. Excessive polling or "bot-nesting" (bots talking to bots) is prohibited and may lead to API rate limiting.
4. WhatsApp Compliance Disclaimer
Crucial: All users must adhere to the WhatsApp Business Policy and Commerce Policy. Meta reserves the right to ban numbers that violate these policies.
- We are NOT responsible if your WhatsApp number is banned or restricted by Meta.
- Template approval is solely at the discretion of Meta.
- Messaging limits (tiers) are determined by your WhatsApp quality rating and volume, regulated by Meta.
5. Subscription & Billing
Usage of the platform is subject to subscription fees as outlined in our pricing plans. Fees may include:
- Fixed monthly/yearly subscription costs.
- Meta conversation-based charges (where applicable).
- Add-on service fees.
Subscription plans can be upgraded or downgraded through the billing dashboard. Changes take effect as per the billing cycle rules.
6. Account Suspension
We reserve the right to suspend or terminate your account without notice if:
- You violate these terms or WhatsApp policies.
- Your account is used for spamming or illegal activities.
- There is a failure to pay subscription fees.
- There is any abuse of our system or staff.
7. Limitation of Liability
To the maximum extent permitted by law, WaMeTo shall not be liable for any indirect, incidental, or consequential damages, including loss of profits or business interruption, resulting from:
- Service downtime or technical failures.
- WhatsApp outages or Meta policy changes.
- Loss of data or business numbers.
8. Intellectual Property
The platform UI, software, AI flow builder, and all proprietary algorithms remain the exclusive property of WaMeTo. Users are granted a limited, non-transferable license to use the service for their business operations.
9. Termination
You may cancel your subscription at any time through the dashboard. Upon termination, your access to the service will continue until the end of your current paid billing period.
10. Modifications
We reserve the right to modify these terms, our plans, or features at any time. Significant changes will be communicated via email or platform notifications.
11. Governing Law
These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in India.
